The website www.palidou.com  is an online store (e-shop) displaying the products (handmade jewelry) of the sole proprietorship of Mrs. Palidi Christina, daughter of Kyriakos and Andersen – Elze Maria. It is a legal enterprise located at 37 Pavlou Mela street, Heraklion, Crete, 71500, Greece with greek VAT number 137227820, Heraklion tax office, Trade Registry Number (gr: GEMI): 144877327000, e-mail: info@palidou.com, and will be so forth referred to as the “ENTERPRISE”. At the above address is located the jewelry workshop, which is not open to visitors.

The ENTERPRISE has set as its primary goal the excellent service and satisfaction of customers who navigate at www.palidou.com through the creation and cultivation of a trusting climate.

It is important that our customers are aware and secure, so we feel obliged to inform visitors/ customers of the e-shop www.palidou.com  of the following terms and conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR E-SHOP AND OUR WEBSITE. By using the website www.palidou.com and its internet pages, users signify their assent and agreement to these terms. If you do not agree to these terms you should immediately discontinue any use of the website/e-shop www.palidou.com.

II. INTRODUCTION

The following terms and conditions will be applied for the use of the e-shop of Mrs. Palidi Christina (forth referred to as the: “ENTERPRISE”), which can be found at the website www.palidou.com. Every user (from here on referred to as visitor or user or customer depending on whether he/she simply visits the e-shop or orders and purchases products) who enters and completes a transaction, states that he is aware of these terms and conditions, accepts them and agrees to conform to the terms and conditions of the e-shop. The ENTERPRISE is not responsible for whatever arises from his/her visit to the site www.palidou.com. Any other terms and conditions, other than the following, are strictly excluded. All transactions through www.palidou.com  fall under Greek and European Laws in accordance with electronic commerce as well as under the Law regarding consumers [Law 2251/1994] and distance selling.

The ENTERPRISE reserves the right to modify or revise the terms and conditions of use and transactions of the online store whenever it deems necessary, in accordance with its needs, and undertakes to inform consumers of any change through the internet pages of this online store. Thus, we encourage you to visit these Terms & Conditions regularly to ensure that you are fully aware of them.

If you use the website www.palidou.com after the modification announcement of terms and conditions, you agree to the new (modified) terms and conditions.

Any invalidity of any of the terms herein does not invalidate the rest. Failure by the ENTERPRISE to exercise any of its rights hereunder does not imply a waiver of those rights. The ENTERPRISE

is not responsible for any breach of these terms due to force majeure, such as extreme weather events, earthquakes, floods, fires, emergencies, etc.

Bearing in mind quality service, we select from our customers the necessary data for their secure and efficient transactions. The ENTERPRISE strictly adheres to the terms of protection of personal data as stated in the General Data Protection Regulation (GDPR). The ENTERPRISE, always moving within the relevant legal framework, retains the right to change the terms of the protection of personal data only after notifying its users/visitors to the e-shop and the corresponding web pages.

Under no circumstances does the ENTERPRISE reveal, sell exchange, rent out or in any other way give to others the information our customers have entrusted to us. The only exception being if we have informed our customer and he has consented to the collection of data, and/or the revelation of personal data for legal reasons and/or for the order to proceed. In any case, however, customer data is retained by the ENTERPRISE only until the transaction is completed.

THE ENTERPRISE accepts no liability if the personal data given to us is incorrect or falsified in any way. The user is obliged to inform the ENTERPRISE of any changes by sending an email to: info@palidou.com.

The data the ENTERPRISE collects and the reasons:

Navigating to www.palidou.com and accessing this website does not require the disclosure of personal data. Your personal data is only used for the purchase of goods from the e-shop www.palidou.com and for your orders (informing the buyer of the status of his order etc.)

When placing an order from our e-shop in order to ship the ordered products to you, we need you to fill in the appropriate fields with your name and surname (or ENTERPRISE name – optional), your address, your email address and your phone number (mobile or landline). Finally, there is the option to subscribe to our newsletter for email updates on new products and offers.

The ENTERPRISE collects and uses the specific data: i) To complete the transaction that our customers have requested from www.palidou.com (e.g. confirmation of order etc.), ii) For the continuous improvement of our services/products, iii) For commercial communication/ sale promotion (informing you of new products and services provided by the ENTERPRISE, offers etc., once you have selected the relevant field when ordering), iv) to gather statistics that regard our customers and their purchase from www.palidou.com.

To support your experience throughout the site www.palidou.com, to manage access to your account and for other purposes described on the PRIVACY POLICY page, you can register as a user by entering your full name and email address in the relevant fields. It is hereby expressly agreed that any disputes that may arise from the application of these terms and the general use of our online store, unless resolved amicably, fall under the jurisdiction of the Courts of Heraklion Crete.

The ENTERPRISE undertakes not to disclose the details of its customers and transactions unless it has a written authorization from them or it is imposed by a court decision or a decision of another public authority.

The ENTERPRISE is committed towards the validity and quality of the information  provided in the online store, both regarding the identity of the ENTERPRISE and the e-shop transactions provided through the online store, as well as the existence of the essential characteristics described on a case-by-case basis for any product available. However the ENTERPRISE is not liable for any technical or typing errors which cannot be foreseen or have occurred unintentionally or following interruptions to the website by force majeure. The ENTERPRISE is entitled to correct any errors, whenever it realizes their existence.

VIII. RESTRICTED LIABILITY

The ENTERPRISE fully complies with the provisions of the Greek Civil Code regarding sales, as well as the provisions of Law 2251/1994 on Consumer Protection, as they have been modified to date.

The ENTERPRISE accepts no responsibility and offers no compensation for damage for the cancellation of orders, for delays in orders except those underlined in RETURN OR REPLACEMENT OF PRODUCTS.

• Orders will be sent on time except, when there is a case of force majeure.
• Assurance is given that the customer will be informed of possible delays in delivery.
• In the context of good faith and transaction ethics, the COMPANY is under no obligation to accept any order or to proceed with the sale of a product, if there is a typing error at the e-shop price, whether this is above or below the asking price. If such an error is found in an order in only part of the ordered products, then the order is valid and executed normally for the correctly priced items and is considered incomplete for the products in which the error was found.
• The e-shop contains all the information, names, photographs and illustrations of the products, that are available through the website.
• The ENTERPRISE accepts no legal liability for whatever damages are incurred [negative, specific or positive, indicative but not restrictive, separately of accumulatively to the loss of profits or data, to profit gained or monetary gain etc.] to a visitor of the e-shop or to reasons that are connected to/or the operation of the internet website and/or  the unavailability of products and/or services and/or information given by him/her and/or the illegal intrusion of others to products and/or services and/or information given by him.
• The ENTERPRISE does not warrant the accuracy or completeness of all information contained at the e-shop www.palidou.com, nor guarantee that the use of its website will be uninterrupted, error-free, virus-free, malware-free, or that any error of the website will be automatically corrected.

IX. LEGAL PROPERTY RIGHTS

This website is the official e-shop of Mrs. Palidi Christina. All the contents of the website, including the title, signs, images, graphics, photographs, designs, texts, model names collections, emblems and so on, are the legal property rights of the ENTERPRISE and fall under the protection of Greek, European and International laws regarding the legal rights of the website which has a license for use of its exclusive needs and the operation of the e-shop.

Copying, transference or the creation of productive work based on its content or public deception regarding the provider of the e-shop is forbidden. The reproduction, republication, uploading, announcement, dissemination or any other use of the contents in whichever way or means for commercial or other purposes is only allowed after written consent is given by the ENTERPRISE or any other legal beneficiary of the above legal rights. The names, images, letterhead and distinguishing signs which are referred to and describe the ENTERPRISE and/or its e-shop at www.palidou.com or its products or the ENTERPRISE’s services to third parties are the property rights of the ENTERPRISE or the relevant third parties are protected by the relevant laws of commercial trademarks. In any case, the appearance and display of trademarks on the website www.palidou.com and the e-shop of the ENTERPRISE shall in no way be construed as a transfer or grant of a license or right to use them to anyone.

X. USER LIABILITY

The user/customer agrees and accepts the use of e-shop services information and the data as specified under the law based on the regulations of good faith and transactional ethics. The ENTERPRISE does not correct or intervene in the data the user conveys, who is obliged to fill in truthfully and accurately the following: name, address message etc., on the online forms of the website. Based on the above, the user is obliged not to use the e-shop www.palidou.com for:

1. Distribution, publication, e-mail correspondence or transference in other ways of illegal content for whatever reason, cause illegal insult or damage to the  ENTERPRISE or to a third party either by betraying confidentiality or the personal information of whoever.
2. Distribution, publication, e-mail correspondence or transference in other ways, content which causes insult to user ethics, societal principles or minors etc.
3. Distribution, publication, e-mail correspondence or transference in other ways, content which user have no right to transfer according to the law or the valid contracts [such as domestic information, property and confidential information which were reveal as part of work relations or which reveal confidential agreements]
4. Distribution, publication, e-mail correspondence or transference in other ways, content which violates in any way inventions, commercial trademarks, commercial secrets, legal rights or other property rights of third parties.
5. Distribution, publication. e-mail correspondence or transference in other ways whichever software which contains viruses or other codes files or programs which have been designed to interrupt, cause damage to equipment or the operation of whichever computer software or material.
6. Intentionally or unintentionally violate existing legislature or regulations.
7. Harass others in whichever way.
8. Collection or saving of personal data related to other users.    

XI. BUYING PRODUCTS

We aim to serve you through a simple, fast, secure and enjoyable transaction process: Surf at www.palidou.com, choose the products you are interested in and wish to purchase. Add them to your shopping cart by clicking on the ‘’add to cart” button, which is the same for any purchase for the duration of your visit at www.palidou.com. In this way you create your order. You may add or remove products whenever you want before your order is completed. Then follow the steps of the short checkout process to complete the shipment of your order, after first filling in the required fields the appropriate, necessary information.

After completing the ordering process, you will receive an informative e-mail from us confirming your order has been completed.

The purchase of the products is confirmed after your order has been completed and the payment has been approved by the ENTERPRISE. When you place your order, you will receive an automated e-mail indicating the details of your order.

If there is a delay in your order you will receive an e-mail with details. Alternatively, we will call you at the numbers you have provided us, when placing your order on our website.

The website www.palidou.com makes every effort to provide high quality services. However, cases of price errors and secondary product features cannot be ruled out, and website crashes or human errors when updating the price of a product on the website may happen.

XII. PRICE POLICY –  SHIPPING COSTS – INSURANCE AND DELIVERY OF PRODUCTS

The stated prices of the products include greek VAT

are set by the ENTERPRISE. The ENTERPRISE reserves the right to change the prices without prior notice to the customer. In any case, the customer will pay the price stated at www.palidou.com at the time of the order placement.

Free shipping policy applies anywhere in Greece for one time (no free reshipping) for all orders, regardless of the amount. For any other worldwide shipments, the customer is charged with shipping costs and there are two options: the Greek post office or the DHL EXPRESS courier company. The shipping policy of the products may be changed by the ENTERPRISE, after informing the customers through the website www.palidou.com.

Customers outside the European Union may have extra costs arising from exchange differences, customs clearance, import taxes, restrictions on merchandise and local laws for  which the ENTERPRISE bears no liability.

THE ENTERPRISE insures each product from the time of it is delivered to the courier/post until the customer receives it. All products are packaged in a special protective packaging in order to be received by the customer in excellent condition. The ENTERPRISE assumes no responsibility for deliveries that do not take place by force majeure. Shipments and deliveries of the products are made to the address, which the customer registers during the order, and it is the customer’s responsibility to register the correct shipping details. The ENTERPRISE does not assume responsibility for non-delivery of products to customers, who have incorrectly entered their personal information. If the order returns to the ENTERPRISE because the customer has not received it or because the courier or post office has failed to complete the delivery, the customer will bear the cost of the reshipping. The above apply to reshipments of products to Greece and to other countries of the world.

XIII. PAYMENT METHODS

For your very own convenience, we suggest the following payment methods for your purchases:

For purchases made through our website www.palidou.com,  you can deposit the equivalent of your order at the bank account of Mrs. Palidi Christina, strictly within 5 days, counting from the date that your order has been registered. If not, your order will be cancelled.

2.       Your order’s number, which will be sent to you via e-mail, after your order’s checkout process.

► B. Credit Card

When purchasing a product from our e-shop www.palidou.com:

 You will be redirected to the e-POS platform of Alpha Bank, a pioneer in the field of secure electronic transactions, which guarantees the credibility and security of your purchases.

Your card data will not be stored anywhere and it is not released to any third parties whatsoever (not even to the provider of the product you are buying). The ENTERPRISE does not collect or store your card data. That is the reason why you need to re-enter your card data every time you purchase products from our online store.

► C. PayPal

When choosing to pay through PayPal you will be forwarded to PayPal’s official website (secure online transaction system) where you can pay either with your credit/debit card or through your PayPal account. The process of payment through PayPal is fully automated. During this process, any personal information (including your credit card number) is not stored in the system of the ENTERPRISE.

XIV. ORDER DELAYS

All our products are handmade and we need 1-3 business days for their construction. In the case of large quantities of ordered products or in times of high demand (eg Christmas season), the construction time of our handmade products may be longer. The ENTERPRISE informs the customers for any order delay.

Your order may be delayed for the following reasons:

1. In times of extreme weather or strikes, as well as in cases of force majeure, that may affect the shipment and delivery of your order.

2. If it is impossible to contact you by phone or e-mail, in case there is a problem with your order, either in relation to the product (eg its construction process) or in relation to payment, because e.g. the information you entered in the forms is incorrect.

XV. RIGHT OF WITHDRAWAL – PRODUCT CHANGE ΑND RETURN POLICY

1. The customer / consumer has the right to withdraw from the product purchase contract within fourteen (14) calendar days of the receipt of the product, without giving any reasons. The consumer has exercised his right of withdrawal within the time limit for withdrawal, if the consumer sends the notice of exercise of the right of withdrawal to the ENTERPRISE before the expiry of the above period. The consumer bears the burden of proving that he has exercised his right of withdrawal. In order to exercise the right of withdrawal, the customer / consumer must, prior to the expiration of the 14-day withdrawal period, inform the COMPANY of his / her decision to withdraw from the contract by sending an e-mail to info@palidou.com with the following content:

The customer / consumer, who exercises the right of withdrawal, is obliged to return the product in the best condition he/she has received it, and is charged with the shipping costs. The most important condition for the withdrawal is that the returned product has not been used and is in excellent condition, just as before its sale, in full original packaging (box, etc.) which should not be damaged, and with all contents of the original packaging, including the original proof of purchase.

If the customer / consumer withdraws from the contract, the ENTERPRISE shall refund any payment received by the consumer, including the shipping costs, if  the customer has chosen the cheapest standard delivery method provided by the ENTERPRISE. The ENTERPRISE uses the same means of payment to those that the consumer used for the original transaction, within a reasonable time which may not exceed 14 days from the date of receipt of the returned product.

All jewelry of the online store www.palidou.com is handmade and constructed by customer orders through the above website. Customers are solely responsible for the correct data regarding all items, related to the order. It is the customer’s sole responsibility to choose the right size of a ring, bracelet, hair accessory, etc. so that it is properly applied to the finger, wrist, head, etc. of the customer. The ENTERPRISE has no responsibility if the customer chooses the wrong size of any product that he/she has ordered. If the customer receives a product and is not satisfied with it or if the product’s size is incorrect, the customer may, within twenty (20) days after the receipt of the product, contact the ENTERPRISE by email to info@palidou.com explaining the reasons for his/her dissatisfaction and attaching a photo of the product, proving his/her reason for dissatisfaction. After reviewing and approving the customer’s request, the ENTERPRISE will send an email to the customer with  a coupon – code of equal value to the product, that the customer wants to replace. The customer will send, bearing the shipping costs, the product and will also cover the shipping costs to receive the desired replacement product, which has equivalent value to the returned product. The customer may choose to replace the returned one with any other product from the online shop www.palidou.com. If there is any difference in the value of the products (returned and replacement product), the difference will be paid by the customer before shipment. If the customer chooses a lesser-priced replacement product, the difference will not be refunded by the ENTERPRISE. The cash difference is credited to the customer’s name for future purchases.

The customer recognizes by accepting these terms an understanding of the nature and the way of construction of the products (handmade) and thus recognizes that there may be variations from product to product even if they constitute more units of the same product category (eg. rings). The above variations do not constitute a defect and the customer cannot return any product solely for this reason. The customer also acknowledges by accepting these terms that the color of each product, as shown in the photos on the online store www.palidou.com, may not necessarily correspond to the actual color of the product, because the display of the photo from the online store depends from the resolution and type of monitor – screen that the customer uses.

The ENTERPRISE makes every effort to give the customer the most complete picture of the product, but some features of the product may not be visible in the photos of the online store www.palidou.com.

ΧVI. RETURN OR REPLACEMENT OF PRODUCTS

• The customer has the right to return the products that he has purchased and request their replacement: 1) In all cases that the ENTERPRISE is proven responsible for sending to the customer products other or considerably different than those he/she has ordered [e.g. faulty or poor quality product] and 2) in all cases where there has been a genuine defect in the product.
• All product purchased through www.palidou.com can only be replaced by www.palidou.com.
• Return of the product for replacement is accepted within thirty (30) calendar days from the date of receiving the product by the customer and only after submitting a corresponding «return request” by email to info@palidou.com. The customer must attach a photo of the product to the email and if the ENTERPRISE considers that the product is indeed defective or incorrect (in relation to the order), bears the shipping costs. The ENTERPRISE is obliged to confirm in writing (via email) the “return request” upon receipt within a reasonable time after receipt.
• Replacement will take into account the value stated on the purchase receipt. If the product will be replaced with one of lesser value [the customers chooses another product from the e-shop] the ENTERPRISE will not reimburse the difference to the customer. The difference is credited to the customer for future purchases.
• The product to be replaced / repaired must be accompanied by the original receipt of purchase.
• The products to be replaced should be in their initial condition (as purchased by the customer), and their packaging should be the one that normally accompanies the product along with all the documents accompanying the product (eg invoice, receipt, etc.).
• The cost of returning products to the ENTERPRISE is paid by the ENTERPRISE only for the first time through the courier services the ENTERPRISE cooperates with. However, if the products are returned or replaced a second or third time the customer is charged. The cost of re-shipment is paid by the ENTERPRISE. The above apply only to Greece.

Regarding any other worldwide shipments, in the case of returning the product for any reason and the reshipment of the product, the customer will be charged the shipping costs (there is the choice of the Greek posts or the DHL Express courier).

• If the customer chooses other shipping companies, than those cooperating with the ENTERPRISE for the return of the products, he/she will bear the cost of returning in any case and the ENTERPRISE cannot guarantee the customer the time of receipt of the returned products. At the same time, the ENTERPRISE does not guarantee the safety and security of the goods returned through other shipping companies (other than those cooperating with the ENTERPRISE) and may not be responsible for these products.
• After the “return request” is submitted, the ENTERPRISE informs the cooperating courier service and organizes to pick up the products that will be returned from the customer’s address (in Greece and Cyprus) to deliver them to the ENTERPRISE for quality control.
• After receiving the returned products and completing the quality control, the ENTERPRISE will, in a reasonable time period, inform the customer about the procedure for the replacement of the products.

In any case, the return and the replacement of products is possible under the following conditions:

• The product has not been used.

• The product is accompanied by all the necessary documents proving the transaction (invoice, receipt etc.).

XVII. ORDER CANCELLATION

A customer can cancel his/her order only before completing and verifying the order using the e-shop www.palidou.com. During the online order process the customer can remove quantities of products from his/her shopping cart.

XVIΙI. JURISDICTION
